§ 2 Subject Matter and Scope of Services

(1) Sebafood is a digital, AI-assisted application for analysing food, meals and recipes and for supporting personal nutrition-related decisions.

(2) Depending on availability and the stage of development, Sebafood may include in particular:

- identification of possible foods and ingredients from uploaded photographs;

- estimation of nutritional values such as energy, carbohydrates, sugar, fat and protein;

- information about the composition and nutritional characteristics of meals;

- consideration of selected dietary preferences, such as vegetarian or vegan diets;

- nutrition-related classification of foods and ingredients using the analysis features available at the relevant time;

- suggestions for alternative ingredients, recipes and preparation methods;

- creation of shopping lists;

- adjustment of recipes and ingredient quantities according to the selected number of servings;

- comparison of estimated nutritional values with general reference values;

- storage and management of certain analysis results where this feature is offered and enabled by the user.

(3) Not all features are necessarily available at all times, in every region or in every language. The actual scope of services is determined by the features currently made available in the Application.

(4) Sebafood may develop, modify or supplement features provided that contractually agreed services and mandatory statutory rights of users are not unlawfully impaired.

---

§ 3 Use of Artificial Intelligence and Limitations of Analysis

(1) Sebafood uses artificial intelligence and automated calculation methods to analyse images and generate nutrition-related information.

(2) Results are generated automatically and may be incomplete, inaccurate or incorrect. In particular, ingredients, quantities, preparation methods, hidden ingredients and nutritional values cannot always be reliably determined from a photograph.

(3) Nutritional information, serving sizes, recipe suggestions and other assessments are generally estimates and guidance unless expressly identified as verified information from a specified reliable source.

(4) Sebafood does not guarantee the complete or error-free identification of ingredients, allergens, additives, contamination or other components of a food or meal.

(5) Users must independently verify information relevant to their decisions, particularly by consulting packaging, ingredient and allergen lists, manufacturer information or, where appropriate, the provider of a meal.

(6) Where an analysis is uncertain, Sebafood may request additional information, display several possible results or indicate that an analysis is uncertain.

(7) AI-generated content will be identified as such where required by applicable law.

---

§ 4 No Medical Advice

(1) Sebafood is intended for general nutrition information and personal guidance.

(2) Sebafood does not replace a medical examination, medical diagnosis or treatment, or individual advice from appropriately qualified professionals.

(3) Nutrition-related assessments do not constitute medical confirmation of suitability, diagnosis or safety.

(4) Individual reactions to foods can vary considerably. A meal presented by Sebafood as generally suitable or favourable may nevertheless be unsuitable for an individual user.

(5) Persons with allergies, intolerances, medical conditions, special dietary requirements or medically prescribed diets should discuss relevant decisions with appropriately qualified professionals and independently verify ingredients.

(6) Sebafood is not intended for medical emergencies. Appropriate medical assistance should be sought in the event of acute health concerns.

---

§ 5 Registration and User Accounts

(1) Certain features require the creation of a user account.

(2) Users must provide accurate information when registering. Access to certain features may require successful verification of the user’s email address.

(3) Users are responsible for maintaining the confidentiality of their login credentials and must take reasonable measures to prevent unauthorised access.

(4) A personal user account may not be transferred or made available to third parties without the provider’s consent.

(5) Users must meet the legally applicable minimum age for use of the service. Where consent from a parent or legal guardian is legally required, the service may only be used with such consent.

(6) The provider may refuse registration or restrict or suspend an account where there is an objectively justified reason to do so, subject to applicable contractual and statutory requirements.

---

§ 6 Free Analyses

(1) Sebafood may provide users with a free analysis allowance.

(2) Where provided for in the applicable offer, newly registered users who have successfully verified their email address may receive three free analyses.

(3) The introductory free allowance is generally granted only once per eligible email address.

(4) An entitlement to free analyses exists only to the extent expressly promised in the applicable offer.

(5) Free allowances may be subject to technical, security-related or anti-abuse usage limits.

(6) Unused free analyses cannot be redeemed for cash and are generally not transferable to another user account.

(7) Creating multiple accounts or otherwise circumventing limitations on free allowances for abusive purposes is prohibited.

(8) The introduction or modification of paid services does not automatically create a payment obligation for existing free users.

---

§ 7 Paid Services and Credits

(1) Sebafood may offer paid analysis-credit packages and other expressly identified paid digital services.

(2) A paid contract is concluded only through a separate order expressly confirmed by the user.

(3) Before an order is placed, users will be informed in particular of the total price including applicable taxes, the number of included credits or other scope of the service, and the material payment terms.

(4) A Credit is digital analysis credit that can be used within Sebafood.

(5) Credits are not legal tender and do not constitute electronic money. They are generally not redeemable for cash and are not transferable between user accounts unless otherwise required by law or expressly agreed.

(6) When a paid analysis is performed, the number of credits indicated in the Application for that analysis is deducted from the available credit balance.

(7) Where an analysis is not properly completed due to a technical error attributable to the provider, consumed credits may be restored in accordance with technical capabilities and applicable statutory obligations.

(8) Available credit packages and prices are those displayed at the time of purchase. Changes to future prices do not affect purchases already completed.

(9) Performing a free analysis or creating a free user account does not trigger a paid order.

(10) As long as paid services have not been released for public purchase, this section does not create any entitlement to purchase such services.

---

§ 8 Right of Withdrawal

(1) Consumers generally have a statutory right of withdrawal in relation to distance contracts unless a statutory exception applies.

(2) Details regarding the conditions, time limits and exercise of the right of withdrawal are provided in a separate withdrawal notice.

(3) In the case of digital content or digital services, the right of withdrawal may expire early under the conditions prescribed by applicable law. This may in particular require the consumer’s express consent to performance beginning before the end of the withdrawal period and the confirmations required by law.

(4) Merely accepting these Terms does not result in the loss of a statutory right of withdrawal.

(5) The specific order process and immediate use of purchased credits are additionally subject to the declarations and information presented during checkout.

---

§ 9 Uploaded Images and Rights of Use

(1) Users may submit photographs of food and meals for analysis through the available features.

(2) Users must have the necessary rights to use and transmit the content they upload.

(3) Users should submit only images necessary for analysing food or meals.

In particular, images should not contain people, identity documents, health records or other personal or sensitive information that is unnecessary for the food analysis.

(4) Unlawful content must not be submitted.

(5) Users grant the provider the non-exclusive rights to submitted content that are technically necessary to provide the requested Sebafood functionality.

(6) Such rights are limited to the extent necessary to provide the requested service.

(7) No broader use of user content, particularly for advertising or for training the provider’s own AI models, is authorised solely by these Terms. Any such use would be subject to additional legal requirements or consent where applicable.

(8) Details regarding the processing and retention of images and personal data are set out in the Privacy Policy.

---

§ 10 Acceptable Use

(1) Sebafood may only be used in accordance with applicable law and these Terms.

(2) In particular, the following are prohibited:

- circumventing usage, credit or security limitations;

- automated bulk requests without authorisation;

- abusive creation of multiple accounts;

- submission of unlawful content;

- attempts to gain unauthorised access to other users’ accounts, systems or data;

- deliberate interference with the availability or security of the Application;

- abusive exploitation of errors or technical vulnerabilities.

(3) In the event of a violation, the provider may take appropriate measures, taking into account in particular the nature and severity of the violation and the user’s mandatory rights.

---

§ 11 Availability and Technical Requirements

(1) Use of Sebafood requires a suitable device, an internet connection and, where applicable, a current browser or app version.

(2) The provider endeavours to make Sebafood reliably available.

(3) Temporary limitations may occur in particular due to maintenance, security measures, technical failures or outages of external services.

(4) Continuous availability at a specific level is owed only where expressly agreed.

(5) Statutory rights relating to failure to supply, lack of conformity or defects in digital products remain unaffected.

---

§ 12 Changes to the Application

(1) The provider may implement technically necessary changes, security updates and bug fixes.

(2) Changes extending beyond what is necessary to maintain conformity of continuously supplied digital products will be made only in accordance with the applicable statutory requirements.

(3) Where required by law, users will be informed about material changes and their associated rights.

(4) Mandatory consumer rights remain unaffected.

---

§ 13 Analysis Results, Recipes and Recommendations

(1) Analysis results, recipes, shopping lists and recommendations generated by Sebafood are generally intended for personal use and general information.

(2) Users may use results for their own lawful purposes. Third-party rights in individual content or data remain unaffected.

(3) The provider does not guarantee that suggested recipes or ingredients are suitable for all diets, allergies, intolerances or individual requirements.

(4) Before consumption, users are responsible for independently checking ingredients, allergens, freshness, food hygiene and appropriate preparation.

(5) Where Sebafood displays comparisons with daily or other reference values, these are generally intended as general guidance and do not constitute individually determined medical requirements.

---

§ 14 Data Protection

(1) The processing of personal data is governed by the separate Sebafood Privacy Policy.

(2) The Privacy Policy provides information in particular about the nature, scope and purposes of processing, applicable legal bases, service providers, retention periods, any international data transfers and the rights of data subjects.

(3) Where separate data-protection consent is required for a particular processing activity, such consent will be obtained independently from acceptance of these Terms.

(4) Acceptance of these Terms does not replace any consent required under applicable data-protection law.

(5) Details concerning the processing of images and other information submitted for analysis are set out in the current Privacy Policy.

---

§ 15 Liability

(1) The provider is liable without limitation in cases of intent and gross negligence and for damage resulting from injury to life, body or health where such damage results from a breach of duty attributable to the provider.

(2) In the event of a slightly negligent breach of material contractual obligations, liability is governed by applicable law and may, where legally permissible, be limited to losses that are typical for the contract and reasonably foreseeable.

(3) Otherwise, liability is governed by applicable statutory provisions.

(4) Statutory warranty rights, mandatory liability provisions and claims under applicable product-liability law remain unaffected.

(5) Information concerning possible errors or uncertainties in automated analyses does not limit liability where such liability is mandatory under applicable law.

---

§ 16 Term, Termination and Account Deletion

(1) A free user relationship is generally concluded for an indefinite period.

(2) Users may terminate their free user relationship and delete their user account using the functionality provided for this purpose, subject to applicable statutory requirements.

(3) Existing paid contracts are governed by the terms applicable at the time the respective contract was concluded.

(4) The provider may terminate the user relationship subject to applicable contractual and statutory requirements.

(5) The right to terminate for good cause remains unaffected.

(6) Following account deletion, personal data will be deleted or, where necessary, de-identified or retained only to the extent that a lawful or legitimate basis for continued retention exists, as further described in the Privacy Policy.

(7) Statutory retention obligations and necessary transaction, refund or evidence records remain unaffected.

---

(1) Questions regarding use, technical issues and complaints may be addressed to:

Email: contact@sebafood.de

(2) The provider endeavours to address legitimate complaints within a reasonable period.

(3) Statutory rights to alternative dispute resolution and judicial remedies remain unaffected.

(3) Statutory jurisdiction rules apply to consumers.

(4) Exclusive jurisdiction is agreed only to the extent legally permissible.

---

§ 19 Changes to These Terms

(1) The provider may amend these Terms for the future where there is an objectively justified and legally permissible reason and the applicable statutory requirements are satisfied.

(2) Affected users will be informed of material changes in an appropriate manner.

(3) Where a change requires the user’s consent, such consent will be expressly obtained.

(4) Continued use of Sebafood or a consumer’s silence will not, without an applicable legal basis, constitute acceptance of detrimental changes.

---

§ 20 Final Provisions

(1) If individual provisions of these Terms are or become invalid or unenforceable, their treatment will be governed by applicable law. The remaining provisions will generally remain unaffected.

(2) Individual agreements take precedence over these Terms.
